Terms of Use of the Mobile Application

1. Introductory provisions and definitions
1.1 These Terms of Use (hereinafter as „Terms„) govern the rights and obligations relating to the use of the Golf Slovak Open mobile application ( hereinafter as „Application„) between the operator and the user.
1.2 Operator: IF MEDIA, s.r.o., company with its registered office at Pplk. Pľjušťa 929/31, 909 01 Skalica, Slovak Republic, Company ID (IČO): 43 946 682, Tax ID (DIČ): 2022540696, registered in the Commercial Register of the District Court Trnava, Section: Sro, Insert No. 21449/T, e-mail: info@ifmedia.eu (hereinafter as „Operator„).
1.3 User means any natural or legal person who downloads, installs or uses the Application.
1.4 Stores: Apple AppStore, One Apple Park Way Cupertino, CA 95014. Downloading and updating the Application is also governed by the App Store terms of service. Google Play, operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, California, USA ( hereinafter as „Google“). Downloading and updating the Application is also governed by the Google Play terms of service.
1.5 By installing or using the Application, the User confirms that he/she have read, understood and agree to these Terms. If the User does not agree, he/she must not use the Application and shall uninstall it.
2. Licence to use
2.1 The Operator grants the User a non-exclusive, non-transferable, revocable and free-of-charge licence to use the Application for personal, non-commercial purposes on devices owned or controlled by the User, to the extent of the functionalities the Application provides.
2.2 The Application is provided free of charge.
2.3 The User is in particular not entitled to: copy, modify, decompile or reverse-engineer the Application, create derivative works from it, provide it to third parties for consideration, or circumvent its technical protection measures, unless permitted by a mandatory provision of law or by Operator.
3. User account
3.1 The Application does not require the creation of a user account.
4. Rules of use
4.1 The User undertakes to use the Application in accordance with legal regulations, good morals and these Terms.
4.2 In particular, the User must not: interfere with the security or operation of the Application or related servers; access it by automated means in a manner that places an excessive load on it; distribute malicious code; unlawfully obtain data of other users; or use the Application for unlawful activity.
4.3 The Operator is, without the need for prior notice, entitled to restrict or prevent access for a User who breaches these Terms or misuse the Application.
5. Third-party content and external links
5.1 The Application may display or mediate content from external sources (e.g. video streams from YouTube, articles and news loaded from the golfslovakopen.sk website, and push notifications). This content is provided by third parties and the Operator is not responsible for its accuracy, availability or legality.
5.2 Third-party content and services (e.g. YouTube, Google) may be subject to their own terms and privacy policies, which have to be followed when used by the User.
5.3 Push notifications: The Application may send notifications (via the Firebase Cloud Messaging service). The User can turn them off at any time in the device or Application settings.
6. Intellectual property
6.1 The Application, its source code, graphics, logos, trademarks, texts and other elements are protected by law and are the property of the Operator or its licensors.
6.2 These Terms do not grant the User any intellectual property rights beyond the licence under Article 2.
7. Disclaimer of warranties and limitation of liability
7.1 The Application is provided „as is“ and „as available„. The Operator does not warrant that it will always be available, error-free, uninterrupted or compatible with every device.
7.2 To the extent permitted by law, the Operator is not liable for any indirect, consequential or incidental damage arising from the use of, or inability to use, the Application.
7.3 This is without prejudice to consumer rights under mandatory provisions of Slovak law; with respect to consumers, the Operator does not exclude liability to the extent prohibited by law.
8. Availability, changes and termination
8.1 The Operator is entitled to change or update the Application at any time, change its functionalities, temporarily suspend it or completely discontinue its provision/operation of the Application.
8.2 The User may end their use at any time by uninstalling the Application.
9. Personal data protection
9.1 The processing of personal data is governed by a separate document, the Privacy Policy, available at https://golfslovakopen.sk/privacy-policy-of-the-mobile-application/. This policy describes what data the Application processes (including data needed for push notifications and any analytics) in accordance with Regulation (EU) 2016/679 (GDPR) and Act of the Slovak Republic No. 18/2018 Coll.
10. Additional Google Play terms
10.1 These Terms constitute an agreement between the User and the Operator, not with Google. The Operator is solely responsible for the Application and its content.
10.2 In the event of a conflict between these Terms and the Google Play terms regarding the use of the Application downloaded from Google Play, the Google Play terms shall prevail in the relationship between the User and Google.
11. Changes to the Terms
11.1 The Operator may amend these Terms at any tune without prior notice. The current version will always be available in the Application and/or at https://golfslovakopen.sk/terms-end-conditions/. The User will be reasonably informed of any material changes. By continuing to use the Application after the changes take effect, the User expresses agreement with them and changes of the Terms.
12. Governing law and dispute resolution
12.1 These Terms and the relationships arising from them are governed by the law of the Slovak Republic.
12.2 Any disputes will be resolved by the competent courts of the Slovak Republic.
12.3 A consumer has the right to contact the Operator with a request for redress, as well as to turn to an alternative dispute resolution entity (e.g. the Slovak Trade Inspection, www.soi.sk).

14. Final provisions
14.1 If any provision of these Terms becomes invalid or ineffective, this does not affect the validity of the remaining provisions.
14.2 These Terms take effect on 1 June 2026.
